Federal Judge Advances NAACP Environmental Lawsuit Against xAI Data Center

A federal court denied xAI's motion to dismiss a lawsuit alleging that combustion turbines powering the Colossus data center lacked required environmental permits.

A federal judge has rejected xAI's bid to dismiss a lawsuit brought by the Southern Environmental Law Center on behalf of the NAACP. The lawsuit claims that the AI company operated at least 35 combustion turbines at its Colossus data center site near Memphis without obtaining necessary preconstruction and operating air permits, violating the Clean Air Act.

xAI had argued that the turbines qualified as mobile sources exempt from standard permits and questioned the plaintiffs' standing. The court ruled against the dismissal, affirming the plaintiffs' statutory standing and allowing the environmental compliance case to proceed.
